Terms of service-
The following terms and conditions constitute a legally binding agreement (this “Agreement”) between you (“you” or “your”) and Wide Africa (as defined below) that governs any use by you of the Wide-Africa.com Website (the “Website”) and the services available on or on the Website (taken in conjunction with the use of the Website, the “Services”). We will refer to Wide Africa and all its subsidiaries and affiliated companies collectively as “Wide Africa”, “Wide Africa Art” we “,”our “,”us “, etc.  Wide Africa Art prints and dropships products (“Products’ ‘) directly to you (‘ ‘Customers’ ‘).

Our goal is to find customers who believe in what we believe in and to work together so that we can all make our goals much more successful. The things we do to advance our goals are to promote art, and artists. One of our primary goals is to fund art education projects in underprivileged populations, using percentages of our sales dedicated to that goal.

The Services are offered subject to your acceptance without any change to all the terms and conditions contained herein. We also have other policies and practices including, without limitation, Shipping, Return Policy, Privacy Policy and others. These policies contain additional terms, which apply to the Services and are part of this agreement. YOUR USE OF THE WEBSITE CONSTITUTES YOUR ACCEPTANCE AND AGREEMENT TO BE BOUND BY THIS AGREEMENT. FURTHERMORE, BY PLACING AN ORDER FOR PRODUCTS OR SERVICES FROM THE WEBSITE, YOU ACCEPT AND ARE BOUND BY THIS AGREEMENT. If you do not agree to this Agreement, do not use the Site or any other Services.
If you use our Services for your personal use only, you will be considered a “User.”
WHETHER YOU ARE A USER, SECTION 17 OF THIS AGREEMENT REQUIRES THAT ALL DISPUTES (AS DEFINED BELOW) ARISING OUT OF OR RELATING TO THIS AGREEMENT BE RESOLVED BY ARBITRATION ON AN INDIVIDUAL BASIS, RATHER THAN BY JURY TRIAL OR CLASS ACTION, EXCEPT AS OTHERWISE SPECIFIED IN SECTION 17.If your country of residence is in the European Economic Area, this applies to any action you may wish to bring against WIDE AFRICA IN THE UNITED STATES

In order to enjoy all of Wide Africa Art’s benefits, you can register your account and become a member (“Member”). Membership requires you to register on the Site (including by truthfully filling in all necessary personal information). You can opt-out of marketing and promotional activities, including emails. You can cancel your membership at any time by cancelling it online on the Site. To complete the registration, enter a name, last name, email address, and password. You may never use another user’s Wide Africa account without the permission of that user. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify Wide Africa Art immediately of any breach of security or unauthorised use of your account. Although Wide Africa Art will not be liable for you and your Customer’s losses caused by unauthorised use of your account, you may be liable for the losses of Wide Africa Art and others due to such unauthorised use.
Wide Africa Art may modify, cancel or cancel the Services, products, fees, fees, terms, and conditions at any time, including the availability of any feature or content, but without prejudice to orders for users in the European Economic Area. Wide Africa Art may also impose restrictions on certain features and Services or restrict User access to parts or all services without notice or liability. If you are an individual (rather than an organisation or entity), then you certify to Wide Africa Art that you are at least 18 years of age, but if you are an individual residing in Japan, you certify to Wide Africa Art that you are at least 20 years of age. If you use the Services on behalf of an organisation or entity then you certify that you are legally competent and permitted to bind such organisation or entity to this agreement and use the Services. Notwithstanding the aforementioned, you agree to take full responsibility for your selection and use of the Services. This Agreement is void where prohibited by law, and the right to access or use the Services is revoked in such jurisdictions

Without prejudice to orders for users of the European Economic area. Wide Africa Art reserves the right, in its sole discretion, to amend this Agreement and its terms, as well as the fees and other fees for our Services, at any time. Any such modifications will become effective immediately after Wide Africa Art posts them on the site. You shall be responsible for reviewing and becoming familiar with any such changes, and you agree to review the terms of this Agreement each time you access or use the Website so that you are aware of any changes made to this Agreement. Use of the Website and other services by you after Wide Africa Art posts the changes on the Website constitutes your acceptance of the terms of this Agreement, which are amended. If you do not agree to the amended terms and conditions, you are not authorised to access or use the Website or other Services, and you must send a written notice to Wide Africa, including by email (and your Wide Africa Art account will be deleted), to terminate your account within 30 days of notice.

Any content (including any information, images, images, data, text, photographs, graphics, messages and other materials, hereinafter referred to as “Content”) that you post, submit, upload, display, sell or use, hereinafter referred to as “mail”, using our Services is your content. We do not make any claims(s) to it. It includes everything you post using our Services (such as your Content, Images,, Comments, Videos, etc.).

  1. Responsibility for the Content. You understand that you are solely responsible for the Content you post on or through the Services. You represent that you have all necessary rights to the Content, including all necessary rights to post it or use it on your own.
    Permission to use the content. Wide Africa Art agrees that any Content you submit to using our Services will remain your Permission to use the Content with the Matching Rights. This means that we will never use your Content except with your express permission or as otherwise provided for in this Agreement.
  2. Rights you grant wide Africa Art. By publishing your Content, you provide Wide Africa Art with a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable, perpetual license to use, display, edit, modify, reproduce, distribute, store and prepare derivative works of your Content to provide the Services and to promote Wide Africa Art or the Services in general, in all formats and through all channels, including across all Wide Africa Art services, third party website, advertising medium and/or social media. You agree and represent that you have the right to grant this license to us.
  3. Reports unauthorized content. Wide Africa Art respects intellectual property rights and complies with intellectual property laws. We are committed to following appropriate legal procedures to remove content that infringes from the Service(s).

Intellectual property. Wide Africa Art respects your work and allows you to express your voice and ideas. We ask that you respect the work and creative rights of others. You either need to own the content you post in Wide Africa Art or have explicit authority to post it. Content must comply with publicity rights, trademark and copyright laws, and all other applicable state and federal laws.

Trademarks and intellectual property infringements. We are committed to following appropriate legal procedures to remove content that infringes from the Services. Wide Africa Art will attempt to receive and not interfere with standard technical measures used by copyright owners to identify and protect their works. Wide Africa Art reserves the right to do any or all of the following at any time in its sole discretion: (i) immediately discontinue your use of the Services; and/or (ii) remove, block, and disable access to any of your Content that is claimed to infringe the intellectual property rights of others. When we receive accurate notice of intellectual property infringement (by email info@wide-Africa.com or otherwise), Wide Africa Art strives to respond promptly by removing, blocking, or disabling access to allegedly infringing material. When Wide Africa Art removes, blocks or disables access in response to such notice, Wide Africa makes a reasonable attempt to contact the alleged infringing party, provide information about the notice and removal, and, in the event of alleged copyright infringement, provide information about the counter-notification.

  1. DMCA Cooperation: Wide Africa Art’s Copyright Infringement Notice and Content Removal Policies and Procedures are intended to meet service providers’ requirements and obligations under the Digital Millennium Copyright Act (DMCA). To the extent that any requirements and obligations of service providers under the DMCA change or different from those set forth herein, Wide Africa Art’s policy and procedure may likewise be amended according to the DMCA’s requirements obligations for service providers.
  2. Counter DMCA Notifications: If Wide Africa Art receives a DMCA counter-notification, Wide Africa will send a copy of the counter-notice to the original complaining party. Unless the copyright owner files an action seeking a court order against the alleged infringing party and informs Wide Africa Art of this action, the deleted, blocked, or disabled material may be replaced, or access to it may be restored 10-14 business days after delivery of the counter-notice to the original complaining party. If an action is submitted, ais removed, blocked or disabled Content ed shall remain removed, blocked, or disabled in Wide Africa Art’s sole discretion.
  3. Repeat Infringement: Wide Africa Art may terminate account privileges for members who are the subject of repeated notices of intellectual property infringement determined by Wide Africa Art in its sole discretion.
  • Copyright and trademark liability. You agree and represent by accepting this Agreement and using our Services that you own all rights (including copyright) for the Content you post, or if you are not the owner, that you have express authority and written permission to use and reproduce the Content in connection with the Services, and that you have all rights necessary to publish your Content. Similarly, by accepting this Agreement and using our Services, you agree and represent that you own all trademarks, service marks, trademark dresses and trade names incorporated into the content you post, or if you are not the owner, that you have express authority and written permission to use, post and reproduce such marks, trademarks and trade names in connection with any Content and services provided under this Agreement.
  • Inappropriate, false, or misleading content. This should be common sense, bre certain types contend that we don’t want into our Services (for legal reasons or otherwise). You agree that you will not post any content that is offensive, threatening, defamatory, obscene, vulgar, unlawful or otherwise offensive or contrary to any part of this Agreement. You also agree not to publish ais false or mislead content ng or uses the Services inis fraudulent or fraudul mannerent.

We grant you a limited, non-exclusive, non-transferable, and revoked licence to use our Services, Platforms, and Integrations covered by this Agreement and the following limitations in particular:

  1. Do not use our services to break the law. You agree that you do not violate any laws in connection with your use of the Services. This includes all local, state, federal, and international laws that may apply to you or Wide Africa Art. For example, it is your responsibility to obtain any permits or licences that your work may require; you may not engage in fraud, theft, anti-competitive conduct, threatening behaviour, or other unlawful acts or crimes against Wide Africa Art, another Wide Africa Art user, or a third party. You also agree that you are not the target of trade, financial and economic sanctions and that you do not appear on a sanctions-related list, including lists maintained by the U.S. Department of Treasury’s Office of Foreign Assets Control (“OFAC”), U.S. Department of State, U.S. Department of Commerce, European Union or Her Majesty’s Treasury of the United Kingdom. You also agree that you will not export, re-export, or otherwise transfer Wide Africa Art’s Products to countries or territories that are the target of comprehensive embargoes or sanctions (including Cuba, Iran, Syria, North Korea) or parties to the sanctions-related lists referred to above. You agree not to use the Services: (i) to impersonate or attempt to impersonate Wide Africa Art, any other Wide Africa Art Party (as defined below), or any other person or entity; or (ii) to exploit, harm, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise. The following are collectively referred to as “Wide Africa Art Parties”: (a) Wide Africa Art, (b)Wide Africa’s subsidiaries, affiliated companies and joint ventures, and (c) officials, directors, members, managers, shareholders, agents,  of Wide Africa.
  2. Don’t try to damage our systems. You agree not to interfere with or attempt to interfere with our Services, for example by distributing a virus or other malicious computer code in our platforms, third party services or other programs or systems that our clients may use to promote their Products. You agree not to use the Services: (i) to send, knowingly receive, upload, download, use or re-use any material that does not comply with this Agreement; or (ii) engaging in any other conduct that restricts or impedes anyone’s use or enjoyment of the Services, or which, as determined by us, may harm any Wide Africa Art Party or expose any of them to liability. You agree that Wide Africa Art reserves the right to review our platforms (systems) to ensure the integrity and compliance of this Agreement, in its sole discretion of Wide Africa Art
  3. Guidelines for the brand. The name “Wide Africa Art” “Wa” “Wide Africa”, our iconography, phrases, logos and designs that we use in connection with the Products or Services we provide are trademarks, service marks or trading dress of Wide Africa Art manufacturers in the United States, the European Union and any other country, used for their own purposes at our sole discretion. Except as expressly provided in this Agreement, Wide Africa Art does not give you any rights to use its trademarks, service marks or trade dress. You may indicate in connection with the Services or Products provided by Wide Africa Art that Wide Africa Art provided such Services or Products. If you use any of our trademarks with reference to our Products or Services, you must include a statement attributing this trademark to us. You may not use any of our trademarks: (i) in or as a whole or as part of your own trademarks; (ii) in connection with activities, Products or Services that are not ours; (iii) in a manner that may be confusing, misleading or deceptive, or (iv) in a manner that disparages us or our information, Products or Services (including the Site). Wide Africa reserves the right to request that you immediately remove such abused iconography, phrases, logos, and designs in its sole discretion.
  4. Share your ideas. Believe in your dreams and ideas! They can help us improve your experience and our Services and Vision. Any unwanted ideas or other material you send to Wide Africa Art is considered non-confidential and nonproprietary to you. By sending these ideas and materials to us, you grant us a non-exclusive, worldwide, royalty-free, non-revocable, sublicensable, perpetual licence to use and publish these ideas and materials for any purpose, without compensation to you at any time (accept Credit or any details specific)
  5. Communication methods. Wide Africa Art will provide you with some legal information in writing. Using our Services, you agree to our communication methods that describe how we provide that information to you. This simply means that we reserve the right to send information electronically (by email, etc.). Instead of sending you hard copies, you can find Us on the Mail : info@wide-africa.com
  6. Digital objects. Digital objects (such as mockups, templates, images and other design assets) and texts created in connection with the Products and/or Services we offer and their intellectual property rights belong exclusively to Wide Africa Art. Digital articles and any results may only be used in connection with the advertising, marketing, offering and sale of Wide Africa Art’s Products and may not be used for other purposes or in conjunction with products from other manufacturers.

 

  1. Articles your clients buy through our websites. You understand that Wide Africa Art cannot and does not make any warranties about your Content.Any legal claim relating to a Product your works connect to must be yours. You release Wide Africa Art from all claims related to art works send by you to our Services, including claims for incorrect information to us claims for physical or property damage through any of art works u send to or use with Wide Africa Art.
  2. The content you get access to. You may encounter material that they find offensive or inappropriate when using our Services. We make no representations about any content published by others through the Services. Wide Africa Art is not responsible for the accuracy, compliance with the copyright, legality, or decency of content published by others you access through the Services. You release us from any liability relating to that content.
  3. Third-party services. Our stores on our Website(s) may contain links to third-party websites or services that we do not own or control (such as links to Facebook, Twitter, and Pinterest). You may also need to use a product or service by one of our subcontractors or other third parties to use some of our Services (as a compatible mobile device to use our mobile apps). When you access these third-party services, you do so at your own risk. The third parties may require you to accept their own terms of use. Wide Africa Art is not a party to these agreements; . they are only between you and the third party. You agree that Wide Africa Art will in no way be liable to you for your use of these third-party services.
  4. Services. Wide Africa Art is dedicated to making our Services the best they can be, but we are not perfect, and sometimes things can go wrong. (and learn every day how to avoid it) You understand that our Services are provided “in its name,” with all faults and without any form of warranty (express or implied), except for the warranties provided concerning Products in Section 6 below. To the extent permitted by law, WE EXPRESSLY WAIVE ANY WARRANTIES OR CONDITIONS OF NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE, AS WELL AS ANY WARRANTIES OR CONDITIONS IMPLIED BY A COURSE OF PERFORMANCE, TRADING, OR USE OF TRADE, concerning OUR SERVICES, EXCEPT FOR THE WARRANTIES OR CONDITIONS PROVIDED concerning PRODUCTS IN SECTION 6 BELOW. Some jurisdictions do not allow restrictions on implied warranties or terms, so the above restrictions may not apply to you. We do not guarantee that:
    1. services will be safe or available at any given time or place – Wide Africa Art shall not be liable for any delays, interruptions, or loss of data associated with the use of our Website and Services
    2. any errors for Wide Africa Art is responsible will be corrected;
    3. the Services will always be free of viruses or other harmful material; Or
    4. the results of using the Services will meet your expectations.
      You use the Services only at your own risk
  5. LIMITATIONS OF RESPONSIBILITY. To the extent permitted by law, neither WIDE AFRICA nor any other BROAD AFRICAN PARTY shall be liable to you for any lost profits or revenue, decrease in value, or for any consequence; TEMPORARY, INDIRECT, SPECIAL, EXEMPLARY, ENHANCED, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SERVICES OR THIS AGREEMENT, WHETHER (I) IF ANY OF THE PRIOR DAMAGES WERE FORESEEABLE, (II) WHETHER YOU WERE INFORMED OF THE POSSIBILITY OF INCURRING ANY OF THE PRIOR DAMAGES, (III) THE LEGAL OR FAIR THEORY (CONTRACT, DAMAGES, OR OTHERWISE) ON WHICH THE CLAIM IS BASED, AND (IV) ANY SPECIAL CIRCUMSTANCES FOR YOU AND/OR YOUR CLIENT. THE LIABILITY OF THE BROAD AFRICA PARTIES WILL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE SERVICE YOU HAVE PURCHASED OR USED THROUGH THE WEBSITE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL, CONSEQUENTIAL OR CERTAIN OTHER DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.

Does not apply to users residing in the European Economic Area.

  1. Limited warranty. We warrant that the Product upon delivery of a Product to a User or Merchant’s Customer will not be materially defective or damaged (“The Limited Warranty”).
  2. Who can use this warranty? Wide Africa Art extends the limited warranty only to Users and Merchants.Any limited warranty coverage will void if the User or Merchant’s Customer sells or otherwise transmits a Product.
  3. What does this warranty does not cover? This Limited Warranty does not cover any damage to or defect in a Product caused by any of the following: (a) you or third parties; (b) any improper handling (including during shipping), use or storage of the Product; (c) any failure to follow any Product Instructions; d) any changes to the Product; (e) any unauthorised repair of the Product; or (f) any external causes such as accidents, fire, flood, “acts of God” or other acts or events beyond our reasonable control; or (g) any costs or expenses related to the loss of use of the Product or any other costs or expenses not covered by this limited warranty. This limited warranty does not cover any items supplied by third parties, changes in size, or buyer’s remorse.

Finally, as noted elsewhere in this agreement, we, unfortunately, cannot guarantee that the colours and details of our website images are 100% accurate representations of a Product, and sizes may in some cases be approximate. Consequently, this limited guarantee does not cover such issues.

  1. What is the period of coverage? This limited warranty starts on the day of delivery of the Product to the User or Merchant’s Customer and lasts for thirty (30) days (the “Warranty Period”). For the avoidance of doubt, Wide Africa Art acknowledges that the User may be entitled to a longer Warranty Period under certain jurisdictions.
  2. What are your remedies under this warranty? For any material defect or damaged Product, we will, in our sole discretion, either: (a) replace such Product (or the defective or damaged portion of the Product) free of charge, or (b) refund the purchase price paid to us by the User or Seller together with the shipping charges corresponding to the defective or damaged Products.
  3. How do you receive warranty service? Immediately after delivery of a Product to you will inspect  a Product is materially defective (including any defect of Wide Africa in printing) or damaged upon receipt, or if you received the wrong Product, then to be eligible for service under this Limited Warranty, you must submit a claim within the Warranty Period following our Return Policy.
    actions described in this Section 6 are your sole and exclusive remedies (and our entire liability) for any breach of this Limited Warranty. Our liability for a defective or damaged product shall under no circumstances exceed the actual amount we have received for the product, nor shall we under any circumstances, to the extent permitted by law, be liable for any lost profits or revenue, loss in value, or for any consequential damages; Incidental, indirect, special, exemplary, enhanced or punitive damages or losses arising from our products, whether (I) if any of the foregoing damages were foreseeable, (II) whether you were informed of the possibility of incurring any of the prior damages, (III) THE LEGAL OR REASONABLE THEORY (CONTRACT, DAMAGES, OR OTHERWISE) ON WHICH THE CLAIM IS BASED, AND (IV) ANY SPECIAL CIRCUMSTANCES FOR YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM JURISDICTION TO JURISDICTION. WE LIMIT THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES OR TERMS WITH RESPECT TO OUR PRODUCTS, INCLUDING WITHOUT LIMITATION THE WARRANTIES OR CONDITIONS OF MERCHANTABILITY AND SUITABILITY FOR A PARTICULAR PURPOSE, TO THE DURATION OF THE WARRANTY PERIOD. SOME JURISDICTIONS DO NOT ALLOW RESTRICTIONS ON THE DURATION OF AN IMPLIED WARRANTY OR TERMS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

If you are a User residing in the European Economic Area, the legal guarantees established by Directive 1999/44/EC on consumer sales and warranties below apply to the sale of our products. Accordingly, you have the right, free of charge, to have the products repaired (or replaced) within limits set by law, or, in the event of failure of one of the remedies above, to obtain an appropriate reduction in the price of the products, or the contract is cancelled. Delivery costs for returning the product to be repaired or replaced under this clause shall be borne by Wide Africa, as well as any costs related to the delivery to you of the repaired or replaced product.

Violation of this Agreement or other rules will result in your Postal Account’s Wide Africa Art being terminated.
Wide Africa Art and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse or remove any Content available through the Services. Without limiting the foregoing, Wide Africa Art and its designees shall have the right to remove, block, and disable any Content. You agree that you must evaluate and to the extent permitted by law to bear all risks associated with using any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by Wide Africa Art or submitted to Wide Africa Art, including unrestricted information in Wide Africa Art Collaborations, posts, and in all other parts of Wide Africa Art Services.
Without limiting other actions, we may restrict, suspend or terminate our Services and your account, prohibit access to our Site, delay, remove, block or disable host content, and take technical and legal measures to keep you away from the Site if we believe you are creating problems, causing possible legal liabilities, violating this Agreement, or acting inconsistently with the letter or spirit of our policies. We also reserve the right to cancel unconfirmed accounts or accounts inactive for extended periods of time. You are responsible for providing Wide Africa Art with accurate and truthful information (including but not limited to your name and last name if you are a User ). If you have provided Wide Africa Art with false or false information, (a) you shall be obligated to Wide Africa Art for damages and losses (including but not limited to taxes) arising from such false or false statements, (b) you shall incur such damages and losses (including but not limited to taxes) to Wide Africa Art, and (c) Wide Africa Art shall be entitled to charge you for such damages and losses (including but not limited to taxes) and otherwise limit or turn off your access to the Services.

You can choose to save your billing information to use it for all future orders and fees associated with Wide Africa Art’s Products and/or Services. In such a case, you also acknowledge and agree that this information will be stored and processed by third-party PCI DSS-compliant service providers.
When you order a Product or use a Service with a fee, you will be charged, and you agree to pay the fees that apply when the order is placed. We can change our fees from time to time (for example, when we have holiday sales, offer you a discount on basic product prices, etc.). We may choose to temporarily change the fees for our Promotion Or New Services Services. Such changes are effective when we post the temporary promotional event or the new Service on the Website or inform you individually. The sale will be submitted for processing, and you will be charged as soon as you confirm it. You can then receive an email from us.
By placing an order through the Website, you acknowledge that you have the legal right to use the means of payment as a means of payment and, in the case of card payments, that you are either the cardholder or have the cardholder’s express permission to use the card to effect payment. In the event of unauthorised use of a payment method, you will be personally responsible for and shall reimburse Wide Africa Art for damages resulting from such unauthorised use.
In the case of payment methods, you represent to Wide Africa Art’s that (i) the billing information you provide to us is true, accurate, and complete and (ii) as far as you know, fees incurred by you will be honoured by your financial institution (including but not limited to credit card companies) or payment service provider.
If you or your Customer make any return that does not comply with our return policies (as described herein), you will reimburse Wide Africa Art’s for its losses, consisting of fulfilment costs and chargeback management fees (up to $15 per refund).
We may refuse to process a transaction for any reason or refuse to provide Services to anyone at any time at our sole discretion. We will not be liable to you or any third party to refuse or cancel any transaction after processing has commenced.
Unless otherwise stated, you can select the currency from the options available on the website, where all fees and payments will be entered. You are responsible for paying all fees, payments, and applicable taxes associated with our Site and Services. After receiving your order, you can receive an email from us with details and a description of the Products ordered. Payment of the total price plus taxes and delivery must be made full before dispatch of your Products.
Wide Africa Art’s, in its sole discretion, may offer you various discounts, as well as modify, cancel or cancel them at any time. Once you’ve confirmed your order, you may not be able to edit or cancel it. If you want to change certain parameters, Customer addresses, etc., please check if such an option is in your account. We are not bound to make such changes to your order, but we will do our best on a case-by-case basis.
The risk of loss of, damage to, and title of Products is superior to you upon our delivery to the carrier. It shall be your (if you are a User) or your Customer’s (if you are an artist) responsibility to file any claim with a carrier for a lost shipment if carrier tracking indicates that the Product was shipped. In such a case, Wide Africa Art will not make any refunds and will not reship the product. For Users in the European Economic Area, the risk of loss of, damage to, and title of products will pass to you when you or a third party listed by you has acquired the products’ physical possession.
If carrier tracking indicates that a Product was lost in transit, you or your Customer may make a written claim for compensation of (or credit to the Member’s account for) the lost Product following Wide Africa Art’s return policy. For Products Lost in Transit, all claims must be filed no later than 30 days after the estimated delivery date. All such claims are subject to Wide Africa Art’s investigation and discretion.

While many parts of our Products are standard, all Products available for purchase are described on our site’s specific page. We always try to represent each design as accurately as possible via photography and copy points provided by designers, artists, or photographers.
We have a policy of continuous product development so that we can provide you with what we consider to be the best design combined with the best performance, and thus reserve the right to change the specifications of Products, their price, packaging, and any Service associated at any time, without notice. Before ordering, we invite you to have a closer look at the Product Description and Design.
We use our best to give you the best images and descriptions. Unfortunately, We can not guarantee that the colours and details of website images are 100% accurate representations of the product, and sizes can, in some cases, be approximate.
Sometimes during the manufacturing process, products can be damaged. Obviously, we won’t knowingly send damaged items to you (your Customers), but these damaged items can still be used for charitable purposes. Wide Africa Art reserves the right to donate all damaged items with full or partial designs to charity. You hereby waive your right to collect royalties or other fees relating to damaged Products donated.

Your order is to purchase a Product for which you have paid the applicable fee and/or other fees that we have accepted and received. Any Products in the same order that we have not approved do not form part of that contract. We may choose not to accept any orders at our sole discretion.
Orders are placed and received exclusively through the Site. Before ordering from us, it is your responsibility to check and determine the full ability to receive the Products, S. The correct name of the recipient, delivery address, zip code/zip code, current phone number, and email address are imperative to ensure the successful delivery of Products.
All information requested on the cash id must be filled in precisely and accurately. We deliver to most places in the world. You must cover the delivery costs. Delivery prices are additional at the Product’s price and may vary depending on the delivery location and/or type of Products. Additional charges may be added to the order for remote or difficult available locations that require special attention. However, we reserve the right to advise you on any additional delivery charges applicable to your specific delivery address.
Some Products are packaged and shipped separately. We cannot guarantee the delivery date. The extent permitted by law takes no responsibility, except to advise you on known delay, for Products delivered after the estimated delivery date. The average time of delivery can be displayed on the Website. It’s just an average estimate, and some delivery can take longer, or be delivered much faster. All delivery estimates are given at the time of placement, so make sure to let us know as soon as you can if you want to make any changes. In any case, we will do our best to contact you and advise you of any changes. We try our best to make product delivery as easy as possible.
Ownership of the Products will only be transferred to you after we have received full payment of all amounts due to the Products, including delivery fees and taxes, and deliver the Products to the carrier.
We make no warranties concerning any cooperation we undertake with you, including any cooperation concerning Services, Products (including New Products), or any integration with a supplier platform

This Agreement and all disputes and claims arising out of or relating to this Agreement or its subject matter or formation, including extrajudicial disputes and claims, are governed by the State of North Carolina laws, without regard to its conflict of laws rules. These laws will apply wherever in the world you live or are located. Still, if you are a User residing in the European Economic Area or Switzerland, the laws of the Republic of Latvia will apply to all disputes arising out of or in connection with this Agreement. Notwithstanding the aforementioned, nothing in this Agreement, including the aforementioned choice of law provision, affects your rights as a user residing in the European Economic Area or Switzerland to invoke any mandatory provisions of the law of the country in which you reside.
For users in the European Union: Alternatively, you can contact the Consumer Centre in your country, or you can decide to access the platform for alternative out-of-court settlement of disputes provided by the European Commission.

“Disputes” means all disputes and claims arising in connection with or in connection with this Agreement or its subject matter or formation, including extrajudicial disputes and claims, excluding only claims under the limited warranty and claims brought by users residing in the European Economic Area or Switzerland against Wide Africa Art in the European Economic Area. All Disputes shall ultimately be settled by final and binding arbitration, using the English language, administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules (“Commercial Rules”) in effect at that time. The rules are deemed to be transposed by reference to this Agreement. From the date of this Agreement The Federal Arbitration Act applies to this Agreement. The arbitration shall be administered by the AAA and shall be conducted by a single arbitrator selected in accordance with the trading rules unless otherwise agreed by the Parties. Unless you and Wide Africa Art agree otherwise, any arbitration will take place in Charlotte, North Carolina, except that, for Users, any arbitration will take place in the county of your residence. Judgement on any arbitration may be entered and enforced by any court competent to do so. Each arbitration will take place on an individual basis. Neither the arbitrator nor the AAA has the authority to conduct a class arbitration, class action, or settle claims of more than a single plaintiff in anything other than a single proceeding unless both parties agree. You and Wide Africa Art acknowledge that the AAA may conclude that arbitration rules over consumer matters or the International Dispute ResolutiCentre’s rulestre may be more appropriate in some cases. You and Wide Africa Art agree to comply with the AAA’s decision on applicable rules in cases where a party can claim that the commercial rules are not appropriate.
TO THE EXTENT PERMITTED BY LAW, YOU AND WIDE AFRICA KNOWINGLY, VOLUNTARILY, IRREVOCABLY AND ABSOLUTELY WAIVE ALL RIGHTS TO A TRIAL BY JURY OF ALL DISPUTES (AS DEFINED ABOVE). THIS JURY’S TRIAL WAIVER IS INTENTIONALLY DONE AS YOU, AND WIDE AFRICA WOULD PREFER TO RESOLVE ALL DISPUTES (AS DEFINED ABOVE) PROVIDED BY THIS SECTION 17. THIS JURY TRIAL WAIVER IS A MATERIAL INCENTIVE TO ENTER INTO THIS AGREEMENT. FURTHERMORE, YOU AND FAR AFRICA KNOWINGLY, VOLUNTARILY, IRREVOCABLY AND ABSOLUTELY WAIVE ALL RIGHTS TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION OR OTHER FORM OF JOINT DISPUTE RESOLUTION WITH OTHER PARTIES. Notwithstanding the foregoing, you may instead claim your claim in a dispute in the “small claims” court if you give us written notice of your intention to do so before any claim is filed for arbitration and provided that (a) your claim qualifies (b) your claim remains in such court, and (c) your claim remains on an individual, non-representative and non-class basis.
Even so, notwithstanding the foregoing, each party shall have the right to bring an action before a court with the right jurisdiction for injunctive or other reasonable or conservatory relief, pending a final decision by the arbitrator.
You and Wide Africa Art shall each pay 50% of all fees and expenses of the AAA and the arbitrator except in any other way as the commercial rules (or, if applicable, the rules of consumer arbitration or the rules of the International Dispute Resolution Centre). The arbitrator may award such fees and expenses to the AAA and the arbitrator as well as other expenses and reasonable attorneys’ fees to a prevailing party that complies with the provisions of the commercial rules (or, if applicable, consumer arbitration rules or the rules of the International Dispute Resolution Centre).
